AI Car Studio provides AI-powered image transformation services for vehicle photographs, including but not limited to:

• Background replacement and enhancement
• Environment modification (studio backgrounds, showroom settings)
• Color visualization services
• Poster generation services

The Service uses artificial intelligence to modify uploaded vehicle images according to user specifications.

3. Rules and Conduct

By using AI Car Studio, you agree that:

3.1 Image Ownership and Rights

• You own or have obtained all necessary rights, licenses, and permissions to use any images you upload to the Service
• You have the legal right to modify and distribute the images you upload
• You will not upload images that infringe upon the intellectual property rights of any third party

3.2 Prohibited Uses

You shall not use the Service to:

• Upload images you do not own or have rights to use
• Create fraudulent or misleading vehicle listings
• Misrepresent the condition, features, or appearance of a vehicle for deceptive purposes
• Upload images containing illegal content
• Upload images containing persons without their consent
• Violate any applicable law, regulation, or third-party rights
• Interfere with or disrupt the Service or servers
• Attempt to reverse engineer, decompile, or extract source code from the Service
• Use automated methods to access the Service without permission
• Resell or redistribute the Service without authorization

3.3 Accuracy Disclaimer

You acknowledge that:

• AI-generated images are artistic interpretations and may not perfectly represent reality
• Color changes and background modifications are for visualization purposes only
• The Service should not be used to misrepresent a vehicle's actual condition to potential buyers
• You are solely responsible for ensuring any use of generated images complies with applicable advertising and consumer protection laws

4. Intellectual Property and Licensing

4.1 Your Content

You retain ownership of the original images you upload to the Service.

4.2 Generated Images

Subject to your compliance with this Agreement:

• You own all rights to the AI-generated/transformed images ("Assets") created through the Service
• We hereby assign to you all rights, title, and interest in such Assets for your personal or commercial use
• You may use the generated images for vehicle listings, marketing, and other lawful purposes

4.3 License to AI Car Studio

By using the Service, you grant AI Car Studio a non-exclusive, worldwide, royalty-free license to:

• Process and transform your uploaded images as necessary to provide the Service
• Store your images temporarily for the purpose of providing the Service
• Use anonymized and aggregated data to improve the Service

We do NOT use your images to train AI models or share them with third parties, except as necessary to provide the Service.

4.4 AI Car Studio Intellectual Property

All AI Car Studio logos, trademarks, software, algorithms, and Service components remain the exclusive property of AI Car Studio. Nothing in this Agreement grants you any rights to our intellectual property beyond the limited license to use the Service.

5. Fees and Payment

5.1 Pricing

• Current pricing is displayed on the website at the time of purchase
• AI Car Studio reserves the right to change prices at any time
• Price changes will not affect orders already completed

5.2 Payment Processing

• Payments are processed through secure third-party payment processors (e.g., Stripe)
• You agree to provide accurate payment information
• AI Car Studio does not store your complete payment details

5.3 Refund Policy

Due to the immediate digital nature of our services and the computational costs incurred:

• Refunds are generally not provided once image processing has begun
• If the Service fails to deliver any output due to technical errors on our end, you may request a refund or credit within 7 days

5.4 Subscription Terms (if applicable)

• Subscriptions automatically renew unless cancelled before the renewal date
• You may cancel your subscription at any time through your account settings
• No refunds are provided for partial subscription periods

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OR RELIABILITY OF RESULTS.

AI Car Studio does not warrant that:

• The Service will meet your specific requirements
• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• Any errors in the Service will be corrected

6.1 AI Output Disclaimer

You acknowledge that:

• AI-generated content may contain imperfections, artifacts, or unexpected results
• The quality of output depends on the quality of input images
• Results may vary and are not guaranteed to match expectations exactly

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: IN NO EVENT SHALL AI CAR STUDIO, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR: Any indirect, incidental, special, consequential, or punitive damages; Any loss of profits, data, use, goodwill, or other intangible losses; Any damages resulting from your use or inability to use the Service; Any unauthorized access to or alteration of your transmissions or data; Any third-party conduct on the Service.

THE TOTAL LIABILITY OF AI CAR STUDIO FOR ANY CLAIMS ARISING FROM OR RELATED TO THIS AGREEMENT SHALL NOT EXCEED THE GREATER OF: The amount you paid to AI Car Studio in the twelve (12) months preceding the claim, OR One Hundred US Dollars (USD $100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

8. Indemnification

You agree to defend, indemnify, and hold harmless AI Car Studio and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms of Service
• Your use of the Service
• Your violation of any third-party rights, including intellectual property rights
• Any content you upload to the Service
• Any fraudulent or misleading use of generated images

9. Privacy and Data Protection

9.1 Data Collection

We collect and process personal data in accordance with our Privacy Policy and applicable data protection laws, including the EU General Data Protection Regulation (GDPR) and Swiss Federal Act on Data Protection (FADP).

9.2 Image Data

• Uploaded images are processed on secure servers

10. Termination

AI Car Studio may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms of Service
• Suspected fraudulent, abusive, or illegal activity
• Non-payment of fees

10.3 Effect of Termination

Upon termination: Your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Modifications to Service and Terms

11.1 Service Changes

AI Car Studio reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice.

11.2 Terms Changes

We may modify these Terms at any time by posting the revised version on our website. Changes become effective 14 days after posting, unless stated otherwise. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any disputes arising from or relating to these Terms or the Service shall be resolved as follows:

• For EU/EEA Users: You may bring claims in your country of residence in accordance with applicable consumer protection laws.
• For Swiss Users: Disputes shall be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland.
• For Users in Other Jurisdictions: You agree to first attempt to resolve any dispute informally by contacting us. If informal resolution is unsuccessful within 30 days, any dispute shall be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland.

12.3 Class Action Waiver

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND AI CAR STUDIO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

13. General Provisions

13.1 Entire Agreement

These Terms constitute the entire agreement between you and AI Car Studio regarding the Service and supersede all prior agreements and understandings.

13.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13.3 No Waiver

The failure of AI Car Studio to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

13.4 Assignment

You may not assign or transfer these Terms without the prior written consent of AI Car Studio. AI Car Studio may assign these Terms without restriction.

13.5 Force Majeure

AI Car Studio shall not be liable for any failure or delay in performing its obligations due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
